Datuk Seri Najib Razak insists that the Kuala Lumpur High Court’s decision today did not mean he was ordered to pay RM1.69 billion in taxes to the government.

The former premier said the High Court granted a “summary judgment” to the Internal Revenue Board (IRB) to continue its claim for alleged unpaid taxes amounting to more than RM1.69 billion.

However, according to a person in the legal fraternity with knowledge of the matter, the High Court decision effectively means Najib was ordered to settle RM1.69 billion in additional income tax even if it is on a “pay first, talk later” basis.

High Court Judge Datuk Ahmad Bache ruled that Najib, just like everyone else, is subject to the same provisions as ordinary people when it comes to tax matters.

“It depends on how you interpret it. Since a summary judgment was granted to the IRB and since the judgment, which is by the court, compels Najib to pay, the court effectively ordered him to pay pursuant to law.

“No need to put a spin to it. There is noting wrong with the notion that Najib was ordered to pay. He was ordered to pay.

“When yoo’re told ‘pay first, talk later,’ you’re ordered to pay.”

High Court Judge Datuk Ahmad Bache ruled that Najib, just like everyone else, is subject to the same provisions as ordinary people when it comes to tax matters.

“It is ony fair that the defendant, who is a former Finance Minister and former Prime Minister, be subjected to the same provision of penalty, as everyone stands equal before the law,” he said, adding that under the tax recovery system of the country, courts cannot entertain any plea by a defendant when there is a debt due to the government.
