Rosmah’s defence in graft trial ‘bare denial’ – Prosecution

Rosmah is accused of soliciting RM187.5 million from Jepak Holdings Sdn Bhd managing director Saidi Abang Samsudin, through Rizal Mansor, as an inducement to help the company secure the solar project for rural schools in Sarawak.

Rosmah Mansor’s defence in her corruption trial linked to the RM1.25 billion Sarawak rural schools’ solar energy project is a bare denial and has not created doubt in the case, the prosecution says.

It said Rosmah, the wife of former prime minister Najib Razak, was crying foul that she was the victim of a conspiracy, which resulted in her being charged.

The prosecution said Rosmah had denied having instructed Rizal to solicit a bribe as he was not a political heavyweight to be able to make the demand off his own bat.

“Given the accused’s pre-eminence and given the fact that, in her own words, she was ‘sleeping with the PM’, it is highly improbable that Rizal made the demand for himself,” it said.

It said Rosmah, the wife of former prime minister Najib Razak, was crying foul that she was the victim of a conspiracy, which resulted in her being charged.




In the prosecution’s written submission filed in court and sighted by FMT, it said the defence’s stand was that Rosmah had claimed that the culprits included her former aide, Rizal Mansor.

She also pinned the blame on former Jepak Holdings Sdn Bhd managing director Saidi Abang Samsudin and his former business partner, Rayyan Radzwill Abdullah.

Also not spared by Rosmah was ad hoc prosecutor Gopal Sri Ram, who she failed to disqualify in the course of the trial.

“It is also noteworthy that the accused’s defence to each of the charges is one of a bare denial and this is insufficient to create a reasonable doubt as to the truth of the prosecution’s case,” it said.

The prosecution said Rosmah had denied having instructed Rizal to solicit a bribe as he was not a political heavyweight to be able to make the demand off his own bat.

“Given the accused’s pre-eminence and given the fact that, in her own words, she was ‘sleeping with the PM’, it is highly improbable that Rizal made the demand for himself,” it said.

It said that given the totality of the circumstances, it was highly improbable that Rizal merely used Rosmah’s name to solicit the bribe.

It said Rosmah used Rizal to solicit the bribe as she was “far too clever and wily to make the demand herself”.

“And it has woefully failed to rebut the presumption of corrupt intention on a balance of probabilities,” it said.

The prosecution said Rizal, Saidi and Rayyan had no motive to “fix up Rosmah” and that her version of the case “borders from the sublime to the ridiculous”.

It said her evidence to rebut the claim that she received RM6.5 million – the subject matter of the second and third charges – were also a bare denial.

Rosmah is accused of soliciting RM187.5 million from Saidi, through Rizal, as an inducement to help the company secure the solar project for rural schools in Sarawak.

She is also accused of receiving bribes amounting to RM5 million from Saidi, through Rizal, at Seri Perdana in Putrajaya on Dec 20, 2016.

Rosmah is said to have received another RM1.5 million from Saidi at Jalan Langgak Duta here on Sept 7, 2017.

The prosecution had called 23 witnesses while the defence had two. Trial judge Zaini Mazlan will hear oral submissions on April 5.
