Datuk Seri Shafie Apdal can legally be apointed Chief Minister of Sabah in the event Gabungan Rakyat Sabah is unable to tread past its current political impasse regarding candidacy for the said post.
While Article 6(3) of the Sabah State Constitution does provide for the Yang Di-Pertua Negeri to decide who among state legislative assembly members is most likely to command majority support within the assembly, it has to be read together with Article 6(7) of the same constitution.
Article 6(7) dictates that the leader of a party which wins majority seats in the state legislative assembly during a state election can be considered to have majority support within the assembly provided that he (or she) is a member of the assembly.
In the recently held Sabah State Election, WARISAN secured the most number of seats as a single political party but failed to secure a simple majority together with PKR and WARISAN.

Both provisions provide discretionary powers to the Yang di-Pertua Negeri, who, in his opinion, can swear Shafie in as the next Chief Minister of Sabah after taking into account the current political stalemate.
One important factor that the Yang Di-Pertua Negeri can consider is the political instability that may arise should Gabungan Rakyat Sabah come into power given that its component parties cannot even agree on a Chief Minister candidate.
Assuming that Shafie is appointed, he can test his support once the State Legislative Assembly convenes by allowing a motion of no confidence to be tabled in the event it is proposed by an assembly member.
In the recently held Sabah State Election, WARISAN secured the most number of seats as a single political party but failed to secure a simple majority together with PKR and WARISAN.
Every other political party that contested during the clection lagged far behind WARISAN, the closest being UMNO, which won only 14 seats.
