Umno treasurer Datuk Seri Tengku Adnan Tengku Mansor is likely to end up paying only RM40.3 million to the Inland Revenue Board (IRB) instead of RM57.17 million as an out of court settlement with the taxman.
According to the draft consent order filed at the High Court on Sept 30, Tengku Adnan agreed for amendment to the additional assessment notices for six years between 2012 and 2017.
It was reported on Sept 23 that the IRB agreed to settle Tengku Adnan’s income tax arrears out of court during a friendly settlement proceedings which went on for over three hours.
Counsel S. Saravana Kumar who represented the former Federal Territories minister said a consent judgment was recorded during the proceedings but he declined to disclose the terms of the settlement.

According to the draft consent order filed at the High Court on Sept 30, Tengku Adnan agreed for amendment to the additional assessment notices for six years between 2012 and 2017.
It stated that the amended assessment notices were RM53,872 for 2012; RM4,182,392.03 for 2013; RM6,285,357.26 for 2014; RM6,537,624.73 for 2015; RM3,524,071.10 for 2016; and RM19,775,019.49 for 2017.
“Both parties need to discuss within 45 days from the date of the Consent Order on the payment.
“The settlement will be made before Dec 31 this year if both fail to reach agreement on the mode of payment,” it said.

Deputy revenue solicitor Dr Hazlina Hussain and senior revenue counsel Norhisham Ahmad and Al-Hummidallah Idrus acted for the IRB.
The court had on Sept 2 given an ultimatum to Tengku Adnan or Ku Nan to decide by Sept 23 on the settlement of his income tax arrears with the board or the court would continue to hear the summary judgment application filed by the board against him.
On July 24 last year, the IRB had on behalf of the government filed the suit to seek RM57.17 million in income tax arrears from the Putrajaya MP claiming that he still owed income tax for the years of assessment 2012 to 2017, as stated in the Notice of Assessment dated March 15, 2019.
It had in its claim said that because Tengku Adnan failed to pay the income tax amount within 30 days from the date the notice was issued, as stipulated under Section 103 of the Income Tax Act 1967, a 10 per cent tax increase was imposed.
According to the IRB, Tengku Adnan had failed to pay the owing income tax with a 10 per cent increase, which totalled to RM57,167,069.35.
